These Terms of Service ("Terms") govern your use of the website, online ordering system, SMS messaging program and other services operated by Alvarado's Mexican Grill ("we," "us," "our"). By using our services or opting in to our SMS program, you agree to these Terms. If you do not agree, please do not use our services.
1. Acceptance of Terms
By visiting our website, placing an order, opting in to our SMS program or otherwise using our services, you acknowledge that you have read, understood and agree to be bound by these Terms and our Privacy Policy.
2. Eligibility and Age Restriction (18+)
You must be 18+ (eighteen years of age or older) to opt in to our SMS messaging program or to consent on behalf of the mobile account holder. By opting in, you represent that you are 18+ and that the mobile number you provide belongs to you or that you have authorization to use it. Users under 18 are not permitted to subscribe to our SMS program.
Our website and online ordering services are intended for users 13 and older. Users under 13 should not submit personal information through our services.
3. SMS Program Description
Alvarado's Mexican Grill offers an SMS messaging program designed to keep our customers informed about their orders and our latest specials. The program covers the following messaging use cases:
- Order updates: confirmations, pickup-ready alerts and delivery notifications.
- Reservation reminders: upcoming reservation or catering event details.
- Promotional offers: Taco Tuesday deals, Happy Hour reminders, weekend specials, new menu announcements and exclusive subscriber discounts.
- Customer service: follow-ups on inquiries, feedback requests or catering quotes.
- Loyalty and rewards: updates on rewards balances or program announcements (where applicable).
You opt in by checking a clearly labeled, non-pre-checked consent box on our website, by texting a keyword (such as JOIN) to our published number or by providing verbal consent in person. Opt-in is voluntary and is never required to make a purchase.
4. Message Frequency
Message frequency varies depending on the type of messages you receive. Promotional subscribers can typically expect up to 6 messages per month. Transactional messages, such as order ready alerts or reservation confirmations, are sent as needed and are not counted toward the promotional frequency.
5. Message and Data Rates
Message and data rates may apply. Standard message and data rates from your wireless carrier may apply to each message sent or received. Alvarado's Mexican Grill is not responsible for any charges from your wireless carrier. Please contact your carrier for details about your specific plan.
6. How to Opt Out (Text STOP)
You can cancel your subscription to our SMS program at any time. To opt out:
- Reply STOP to any text message you receive from us.
- You will receive one final confirmation message and will not receive further marketing messages.
- To rejoin later, reply with the keyword JOIN or sign up again on our website.
Note: opting out of marketing messages does not unsubscribe you from essential transactional messages tied to active orders or reservations.

8. Carrier Liability Disclaimer
Wireless carriers are not liable for delayed or undelivered messages. Mobile carriers, including but not limited to AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, Boost, MetroPCS, Cricket and Google Fi, are not responsible for any errors, delays or non-delivery of messages sent through our SMS program. By participating, you acknowledge and agree that wireless carriers shall not be held liable for any such issues.
9. Online Orders and Payments
Online orders are processed through third-party platforms (such as Toast). When you place an order:
- You agree to provide accurate contact, delivery and payment information.
- Pricing, item availability and promotions are subject to change without notice.
- Refunds and order corrections are handled per our standard restaurant policy. Contact us directly if there is an issue with your order.
- Payment processing is handled by our payment partners under their own terms and security standards.
10. Acceptable Use
When using our website, ordering system or SMS program, you agree not to:
- Submit false or fraudulent information.
- Use our services to harass, threaten or harm others.
- Attempt to disrupt, hack or gain unauthorized access to our systems.
- Reproduce, scrape or republish our content without written permission.
- Provide a phone number that does not belong to you or that you do not have authorization to use.
11. Intellectual Property
All content on our website, including the Alvarado's Mexican Grill name, logo, menu descriptions, photographs and graphics, is the property of Alvarado's Mexican Grill or its licensors and is protected by U.S. copyright and trademark laws. To the maximum extent permitted by law, Alvarado's Mexican Grill shall not be liable for any indirect, incidental, special or consequential damages arising from your use of our services, including but not limited to lost profits, data loss or service interruptions.
